Terms of Service & Licensing Agreement

Welcome to EuroAerials. By purchasing, downloading, or using any digital media (video footage bundles) from euroaerials.com, you agree to be bound by the following Terms of Service and Licensing Agreement.

 

1. Grant of License & Usage Types

Upon purchase, EuroAerials grants you (the Buyer) a non-exclusive, worldwide, royalty-free license to use the downloaded video footage. However, the permitted use strictly depends on the content depicted within the specific video clips:

  • Commercial Use: Footage that does not contain recognizable private properties, restricted landmarks, or visible trademarks may be used in personal, commercial, or client projects (including monetized YouTube videos, digital ads, social media content, and promotional material).
  • Editorial Use Only: Footage depicting restricted landmarks (e.g., the Eiffel Tower at night, stadiums like Camp Nou), recognizable private properties, logos, or copyrighted designs is strictly restricted to Editorial Use. This means such clips may only be used for news reporting, documentaries, educational purposes, or non-commercial personal projects. They may not be used for any commercial, promotional, advertising, or brand endorsement purposes without obtaining separate, explicit permission from the respective rightsholders.

2. Restrictions of Use

You may not:

  • Resell, redistribute, sub-license, or share the raw, unedited video files as standalone stock footage.
  • Upload the footage to other stock media platforms (e.g., Shutterstock, Pond5, Adobe Stock, Getty Images).
  • Claim ownership or authorship of the raw footage.
  • Use the footage in any context that is defamatory, illegal, pornographic, or misleading.

3. Property Releases & Clearance Responsibilities (CRUCIAL DISCLAIMER)

EuroAerials retains the copyright to the recorded video files themselves. However, EuroAerials does not possess or provide signed property, model, or trademark releases for any of the landmarks, buildings, stadiums, brands, or private properties visible within the footage.

The Buyer assumes all legal and financial responsibility for the usage of the downloaded footage. By downloading our content, the Buyer explicitly agrees to fully indemnify, defend, and hold harmless EuroAerials from and against any and all claims, damages, liabilities, costs, and expenses (including but not limited to reasonable legal fees and court costs) arising out of or related to the Buyer’s unauthorized commercial use of restricted landmarks, trademarks, or private properties depicted in the footage.


4. Refunds, Returns and Download Policy (EU Right of Withdrawal Waiver)

Due to the digital, instantly downloadable nature of our products, all sales are final. By completing the purchase and initiating the download of the digital content, you expressly consent to the immediate performance of this contract and acknowledge that you lose your 14-day right of withdrawal (refund) under EU Consumer Rights legislation. We do not offer refunds, returns, or exchanges once the access links or digital files have been delivered. If you experience technical issues with your download, please contact our support team.

  • Download Window: For security and anti-piracy purposes, each purchase generates a unique, encrypted link valid for 24 hours.

  • Support: If you fail to download the files within this window or experience technical issues, please contact our support team at info@euroaerials.com with your order number. We do not offer refunds once the secure download link has been generated.


5. Limitation of Liability

In no event shall EuroAerials be liable for any direct, indirect, incidental, punitive, or consequential damages arising out of the use or inability to use our digital products, even if we have been advised of the possibility of such damages.


6. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
